Returns

We will gladly accept returns of unused merchandise within 30 days of the sale*. Please note that opened videos, special, custom and bargain items cannot be returned. You will be responsible for shipping charges to return the item. Balazs will refund the purchase price of items returned in new, unused and uninstalled condition upon receipt of the item. Balazs reserves the right to assess a restocking fee based upon the condition of the product upon return (repainting, repackaging, hardware kit, instructions, etc.) However, we do not refund any shipping charges.

Items Damaged in Transit

Inspect all merchandise upon receipt. If any product is defective upon delivery, please notify Balazs immediately. We will arrange to have the defective item returned to us. A replacement for the defective item will be sent upon receipt of the defective item. You will not be responsible for shipping charges to replace the defective item.

Replacing Items Covered by Warranty

Balazs Warranty: If any Balazs product fails within the warranty period, please notify Balazs immediately. We will give you a Return Authorization number (RMA#) so that you can return the item to us for replacement. You will not be responsible for any charges for the cost of the replacement; however, you will be responsible for the shipping charges to return the failed product to Balazs.‡ After receiving the failed product, we will send a replacement to you.

Other Product Warranty: If any non-Balazs product purchased from Balazs fails within its warranty period, please notify Balazs immediately. We will advise you of the most efficient method for having the item replaced. You will not be charged for the replacement; however, you will be responsible for shipping the failed product back to us or to the manufacturer.‡

Replacements/Exchanges

If you would like the replacement or exchange to be shipped immediately, we require payment for the item. Balazs must receive the return item within 15 days of shipping the replacement. When we receive the return item, we will credit you for the amount paid for the replacement. If the return item is not returned within 15 days, Balazs will not refund the payment for the replacement item.

Prices

Our prices are subject to change without notice, however, if you place an order for an item whose price has increased, we will contact you before processing your order.

Taxes

It is the purchaser's responsibility to pay all local, state and federal sales, use and excise taxes, tariffs, duties and any other form of taxes imposed by any applicable governing authority in connection with the, shipment, sale and use of any merchandise. Balazs only has a location in Pennsylvania and sales tax nexus with the state of Pennsylvania, so the only tax Balazs will collect is sales tax for products shipped to delivery addresses in the state of Pennsylvania. Regarding all other delivery locations in the United States besides Pennsylvania, and any other country, the buyer will be responsible for any and all other taxes of any kind.

Delay in Delivery

While Balazs will make every effort to adhere to a quoted delivery date, Balazs shall have no liability to the purchaser for any alleged damages caused by late delivery. Under no circumstances will Balazs be responsible for or will Purchaser be entitled to consequential damages arising out of or owing to any delays in delivery whatsoever.

Payment Terms

Full payment is due upon shipment of all products. Balazs Inc. may authorize other payment terms after completion and review of a credit application. Full payment of each invoice is due within the timeframe agreed to in the Purchase Terms of the credit application. If any invoice becomes past due the account will be placed on credit hold and no orders will be shipped until full payment has been received. A monthly service charge of 1.5% (18% annual), or the highest rate allowed by law, may be charged to all past due invoices. In addition, Balazs Inc. reserves all rights and remedies available to them by law for collecting overdue invoices, including assessing any/all collection costs and reasonable legal fees to your account. Invoices paid by check are subject to a fee of $30, if the check is returned.

Balazs Warranty Statement

The following statement covers all Balazs products except for products that come with their own specific warranty:

Balazs Inc. warrants and represents that the equipment shall be free from any and all defects in materials and workmanship for a period of one year from the delivery of the equipment to Purchaser. The extent of Balazs Inc.'s liability under this warranty as to defects in material and workmanship is limited to the repair of such defects or replacement of any accessory, equipment or part that is defective for a period of one year from the date of delivery to purchaser.

Balazs Inc. shall not be liable for the repair and/or replacement of said equipment if Purchaser utilizes the equipment in contravention of the instructions provided by Balazs Inc. or if any defect is caused by Purchaser in any manner. Purchaser's sole remedy, as stated above, shall be the repair and/or replacement of any defective equipment and purchaser shall make no further claim against Balazs Inc. for any damage, injury or other claim occasioned by Purchaser's use of this equipment.

The warranty provided for herein and the obligations of Balazs Inc. are in lieu of and Purchaser hereby waives any and all other warranties, guarantees, conditions or liabilities, expressed or implied arising by law or otherwise (including, but not limited to, any obligation of Balazs Inc. with respect to consequential damages) and whether occasioned by any act on the part of Balazs Inc. Purchaser's failure to make a claim for any defective equipment shall be limited to the one year period as stated herein above and Purchaser's failure to provide notice of said defect and request repair and/or replacement within said one year period shall be deemed a full and final waiver of any and all claims for repair and replacement by Purchaser.

*Custom and bargain items are non-returnable.

‡If the product weighs more than 5 lbs., please let us know when reporting the product failure. We will help you to minimize the shipping charge for returning the item.
