Warranty

Balazs warrants and represents that equipment it manufactures shall be free from defects in materials and workmanship under normal use for one year from the delivery of the equipment to the original Purchaser. The extent of Balazs liability under this warranty is limited to the repair or replacement of any component found to be defective.

Balazs shall not be liable for the repair and/or replacement of equipment that is modified, abused, not used in its intended manner, or used in combination with other equipment. Purchaser's sole remedy, shall be the repair and/or replacement of any defective equipment and Purchaser shall make no further claim against Balazs for any damage, injury or other claim occasioned by Purchaser's use of this equipment.

The warranty provided for herein and the obligations of Balazs are in lieu of and Purchaser hereby waives any and all other warranties, guarantees, conditions or liabilities, expressed or implied arising by law or otherwise (including, but not limited to, any obligation of Balazs with respect to consequential damages) and whether occasioned by any act on the part of Balazs. Purchaser's failure to make a claim for any defective equipment shall be limited to the one year period as stated herein above and Purchaser's failure to provide notice of said defect and request repair and/or replacement within said one year period shall be deemed a full and final waiver of any and all claims by Purchaser.
